  • The following appeared on 27 December 1913 in the Oswego Daily Times: Conviction in Hinman Case. George Kern Convicted of Moving House Without Permission. May Serve His Sentence. Matter Probably Just Started and There May Be Other Action to Follow -- Recorded Gill's Opinion.  George Kern, foreman in charge of the moving of the Hinman house, was convicted in police court this morning of violating section 180 of the city ordinances and given twenty days in jail or a fine of $25, the maximum penalty. Kern, it is intimated, will serve the time upon the advice of counsel and then bring suit against the city for false imprisonment.  /P/ Judge Gill in a statement said, "Mr. Kern was convicted of violating section 180, chapter 15, of the city ordinances in moving a house on the public street without first obtaining permission of the Common Council and filing a bond. If the Common Council erred in not giving Dr. Hinman permission to move the house it is not for me to decide, in this court neither is it my right to review their action. The question for the court to settle was whether or not the house was moved without first securing the permission of the Council. I find this to be the case and will enforce the ordinances further if any attempt is made to move this building without a legal right." . . .
