The plaintiff alleges that the defendants piled up a quantity of wood and shavings from new buildings which they owned on the roadway of Newkirk street, between Diamond street and Susquehanna avenue, ignited it, and left no watchman to warn passers-by of danger. The child was going along Newkirk street, when her clothing caught fire from flames blown against here by the wind and issuing from the bonfire. She was badly burned around the legs and hips. Louis Kaffenberger, father of the child, also began suit to recover damages for expenses and losses sustained by him in the same accident.
