  • On 14 February 1848, Eleanor Magruder signed the following will: In the name of God Amen I Eleanor Wynne at present of the County of Greene State of Alabama, being in feeble health of body, but of sound and disposing mind and memory and being desirous to settle my worldly affairs whilst I have strength and capacity so to do make ordain and publish this my last will and testament hereby revoking and making void all former wills by me at any time heretofore made, and as to such worldly estate wherewith it has pleased God to entrust to me I dispose of the same in manner following that is to say /P/ First, I do give and bequeathe to each of my four sons hereinafter named, to wit, Osmun A. Wynne, Erasmus Wynne, Williamson Wynne and Robert Wynne the sum of Eight Hundred Dollars to be allotted to them respectively on a settlement of accounts with my Executors and to be deducted out of any debts or demands which may be due and owing to me from them or either of them at the time of my death….. /P/ Secondly I give bequeathe to my daughter Salina Ann Eleanor Ferrell the sum of eight hundred dollars to be allowed or paid her by my Executors in all respects in like manner with the sum of Eight hundred dollars by me hereinbefore given to each of my said sons. I furthermore give, grant, and bequeath to my said daughter Salina Ann Eleanor Ferrell all my real estate consisting of three Hundred and sixty acres of Land the disposition of which will more full appear by reference to a Deed from James Farrell to me. It being the same I have purchased from him the said James Ferrell. I furthermore give grant and bequeath to my daughter Salina Ann Eleanor Ferrell the following negro slaves, that is to say Ned aged about fifty three years, and Maria wife of Ned aged about Forty eight years, Fanny daughter of Maria aged about twenty seven years, Martha daughter of Maria aged about twenty four years, Charles son of Maria aged about Eighteen years, Jasper son of Maria aged about twelve years, Silly daughter of Maria aged about eight years, Rose daughter of Fanny about eight year, Mary daughter of Fanny aged about six years, Martha Ann daughter of Fanny aged about four years, Virginia Lauretta daughter of Fanny aged about two years, Ned son of Martha aged about even years, George son of Martha aged about three years, Matilda aged about sixteen years, Jeremiah son of Matilda aged about four months, Creed aged about forty two years, Reddick aged about twenty two years, Thomas aged about twenty five years, Jacob aged about twenty three years, John aged about thirty years Harry aged about thirty six years, Isaac aged about thirty eight years, Caroline aged about sixteen years, together with all the offspring or natural increase of the said female Negro slaves and each and every of them. To Have and to Hold the said slaves and all their increase as aforesaid to her the said Salina Ann Eleanor Ferrell her Heirs and assigns forever. Futhermore I do give and bequeath to my said daughter Salina Ann Eleanor Ferrell all my personal and perishable property, which I may have at the time of my death, and not specially deeded or willed away. And the said property hereinbefore given and bequeathed to my said daughter Sarah Ann Eleanor Ferrell shall in no manner be subjected to the debts, management or control or benefit of William A. Ferrell husband of Salina Ann Eleanor Ferrell o…….as if she were a Feme sole. /P/ Thirdly I give and bequeath to my Grand daughter Martha Lavina Ferrell, daughter of William A. Ferrell and Salina Ann Eleanor Ferrell a negro girl daughter of Fanny, named Sarah Ann aged about nine years, also negro girl Mary aged about thirteen years, the last mentioned of the said negro girls I have previously given to the said Martha Levina Ferrell by deed of gift, the same having been recorded in the County Court Clerks Office at Eutaw, as will more fully appear by reference and all the offspring or natural increase to her the said Martha Lavina Ferrell of the said Female negro slaves and each of the Female negro slaves and every of them to have and to hold the said slaves all their increase as aforesaid to her the said Martha Lavina Ferrell her heirs and assigns forever. And lastly I do hereby make and ordain Erasmus Wynne and William A. Ferrell Executors of this my last will and testament in Witness of all which I Eleanor Wynne have to this my will written on three half sheets paper, set my hand and seal this fourteenth day of February in the year of our Lord one thousand Eight Hundred and forty Eight. The will was probated 26 November 1849.
